Segurança do paciente, sistema nacional de notificação e aprendizagem e a falta de legislação em Portugal

A segurança insuficiente do paciente é um grave problema de saúde pública em todo o mundo. Nas últimas duas décadas, organizações internacionais (Organização Mundial da Saúde e União Europeia) e comunidades científicas recomendaram mudanças na cultura de segurança das organizações de saúde e no comportamento dos profissionais, juntamente com muitas outras ferramentas importantes de gerenciamento de riscos. Elas recomendam a implementação de sistemas de notificação de incidentes e eventos adversos que garantam a confidencialidade e que sejam não punitivos, como forma de aprender, prevenir e reduzir os danos aos pacientes. Este artigo apresenta um panorama da Segurança do Paciente em Portugal, o Sistema Nacional de Notificação e Aprendizagem, destacando a sua ineficácia devido à falta de conformidade dos profissionais de saúde na notificação de incidentes. A ausência de uma legislação em vigor no país com relação à regulamentação do Sistema Nacional de Notificação e Aprendizagem com garantias legais de confidencialidade e proteção para aqueles que notificam não está promovendo a eficácia do sistema existente nem a melhoria da Segurança dos Pacientes em Portugal. 

Insufficient Patient Safety is a serious public health problem worldwide. International organizations (World Health Organization and European Union), and scientific communities, over the past two decades, have recommended changes in the safety culture of health care organizations and the behaviour of professionals, along with many other important risk management tools. They advise the implementation of confidential and non-punitive incident and adverse event reporting systems, as a way of learning, preventing and reducing harm to patients. This paper presents an overview of Patient Safety in Portugal, the National Reporting and Learning System, highlighting its ineffectiveness due to the lack of compliance of health care professionals in reporting incidents. The lack of existing law in our country regarding the regulation of the National Reporting and Learning System with legal guarantees of confidentiality and protection of those who notify, is not promoting the effectiveness of the existing system, nor the improvement of Patient Safety in Portugal.
